These Terms & Conditions apply to visitors using our website, prospective customers and customers who engage us to carry out work.
2Website Use Terms
By using our website, you agree to use it lawfully and not to misuse, reproduce or distribute its content without appropriate permission.
Information on this website is provided for general guidance. Photographs, descriptions and other content may not represent the exact conditions or requirements of a particular property.
Submitting an enquiry or quotation request does not, by itself, create a contract or guarantee that we will undertake the work.
3Quotations and Pre-Contract Information
We may provide quotations based on the information available at the time, including details supplied by the customer and findings from inspections.
Unless otherwise stated in writing, quotations are subject to the following conditions:
- The quotation will specify its validity period.
- The quoted price will relate to the work and materials described.
- Changes to the agreed scope of work may affect the price.
- Previously concealed damage or unexpected site conditions may require additional work and a revised quotation.
- Any changes to the agreed price or scope should be discussed and agreed upon before the additional work proceeds, except where urgent action is reasonably necessary and legally permitted.
A quotation does not constitute a guarantee that concealed defects or additional work will not be discovered.
4Formation of Contract
A contract will be formed when the customer accepts our quotation and we confirm acceptance in accordance with the agreed terms.
Before work begins, the agreed arrangements should identify, as applicable:
- The work to be carried out.
- The agreed price and applicable taxes.
- The payment schedule and any deposit.
- The anticipated start date and estimated duration.
- Any relevant exclusions, limitations or additional conditions.
Any changes to the agreed work should be recorded in writing wherever reasonably practicable.
5Right to Cancel
Where the customer is a consumer, statutory cancellation rights may apply to contracts made online, by telephone, at the customer's home or through other off-premises arrangements.
Where applicable, consumers generally have a 14-day cancellation period for qualifying service contracts, subject to the relevant legal requirements and exceptions.
Customers wishing to cancel should contact us using the details provided in these Terms & Conditions. We will provide any legally required cancellation information and instructions.
If a customer requests that work begin during the applicable cancellation period, additional requirements may apply. If the customer subsequently cancels, payment may be due for services already performed where permitted by law and the required conditions have been met.
Nothing in these Terms & Conditions is intended to remove or restrict any statutory cancellation rights.
6Deposits and Payments
Any deposit, instalment or final payment must be agreed before the work begins and documented in the quotation or service agreement.
Unless otherwise agreed in writing:
- Any deposit will be payable according to the agreed booking terms.
- The remaining balance will be payable in accordance with the agreed payment schedule.
- Additional work must be agreed upon before it is undertaken, except where otherwise permitted by law.
- Invoices should be paid by the stated due date.
- Any applicable guarantee or completion documentation will be provided in accordance with the agreed terms and applicable law.
Customers should contact us promptly if they believe an invoice contains an error or if a payment issue arises.
7Workmanship and Guarantees
Any workmanship guarantee offered by TVR Roofing Construction Ltd will be subject to the specific terms provided to the customer.
Before relying on a guarantee, customers should check:
- The work and materials covered.
- The duration of the guarantee.
- Any maintenance or care requirements.
- Any exclusions and limitations.
- The procedure for reporting a potential defect.
A guarantee will not be described as covering work unless that coverage has been confirmed by us in writing.
Any applicable guarantee is separate from, and does not replace, the customer's statutory rights.
8Subcontracted or Referred Work
Where a project requires specialist assistance, or we are unable to undertake the work ourselves, we may discuss alternative arrangements with the customer.
If we propose referring a customer to an independent contractor, we will explain the proposed arrangement before the customer enters into an agreement with that contractor.
The responsibilities of each party will depend on the arrangements agreed. Where a customer contracts directly with an independent contractor, the relevant quotation, payment arrangements, workmanship obligations and guarantees should be confirmed with that contractor.
We will not represent an independent contractor's work or guarantee as our own. Nothing in this section excludes any liability that we may have under applicable law.
Where personal information needs to be shared as part of a referral, we will handle that information in accordance with applicable data protection law and our Privacy Policy.
9Site Conditions and Customer Responsibilities
Customers should:
- Provide safe and reasonable access to the property and work area.
- Inform us of known hazards, access restrictions and relevant property conditions.
- Remove or protect belongings where reasonably necessary.
- Obtain permissions or approvals that are their responsibility, where required.
- Inform us of any known roof alterations, concealed services or previous repairs that may affect the work.
We will discuss any access arrangements, scaffolding, equipment or site preparation required for the agreed work.
Where unexpected site conditions affect safety, the scope of work or the ability to proceed, we may need to pause work and discuss the next steps with the customer.
10Spray Foam Removal Disclaimer
Spray foam removal may involve materials that are difficult to access or remove completely.
Although we will carry out the agreed removal work with reasonable care and skill, complete removal of every trace of spray foam cannot be guaranteed where material remains inaccessible or where removal is limited by the condition or construction of the roof.
Any known limitations, risks, exclusions or additional work identified during an inspection should be discussed with the customer before the relevant work proceeds.
11Drone Roof Inspections
Drone inspections may be used to obtain visual information about roof conditions where appropriate and lawful.
The inspection is limited to areas that can be safely and reasonably viewed using the equipment and methods available. A drone inspection may not identify concealed defects, internal damage, structural issues or problems hidden beneath roofing materials.
An inspection report or visual assessment should not be treated as a guarantee that the entire roof is free from defects.
Drone operations will be subject to applicable aviation, privacy and safety requirements.
12Insurance and Liability
TVR Roofing Construction Ltd will carry out agreed work with reasonable care and skill and in accordance with applicable legal obligations.
Our liability will be determined by the contract and applicable law.
Nothing in these Terms & Conditions excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.
We are not responsible for delays or disruption beyond our reasonable control, such as severe weather, subject to applicable law and the terms of the relevant agreement.
Where damage or additional work results from the actions of other contractors, third parties or subsequent alterations, responsibility will depend on the circumstances and applicable law.
Any statements about insurance cover should be confirmed directly with us before being relied upon.
13Data Protection
We process personal information in accordance with applicable UK data protection legislation.
Information provided through our website, by telephone or by email may be used to respond to enquiries, prepare quotations, arrange inspections, carry out agreed work and meet relevant legal obligations.
For further details about the collection, use, sharing and retention of personal data, please refer to our Privacy Policy: https://tvrroofingconstructionltd.co.uk/privacy-policy/
14Complaints and Dispute Resolution
If you have a concern about our services, please contact us and provide details of the issue, including any relevant quotation, invoice, photographs or correspondence.
We will review complaints fairly and aim to resolve them within a reasonable period.
Where a dispute cannot be resolved directly, the parties may consider an appropriate alternative dispute resolution process where available and applicable.
Nothing in this section prevents a customer from exercising their legal rights or bringing a claim before a competent court.
15Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute will be handled by the courts with appropriate jurisdiction, subject to applicable consumer protection legislation and rules governing jurisdiction.
16Updates to These Terms
We may update these Terms & Conditions when necessary to reflect changes to our services, business practices or legal requirements.
The current version will be published on our website. Changes will not retrospectively alter an existing agreement where doing so would be unlawful.
